Commercial Booth Application

As a condition of participation, the above named organization(s) and/or individual(s) agree to indemnify and hold harmless the City of Mukilteo, and the non-profit organization known as the Mukilteo Lighthouse Festival Association, its officers, directors, committee members, employees, volunteers, sponsors, contractors and agents from any and all claims, actions, suits, losses, damages, liability of every type and nature, including, but not limited to, all costs and legal expenses incurred by the Application or any other party, by reason of any activity arising under or in connection with the Applicant’s participation in the Mukilteo Lighthouse Festival, Run-a-Muk or Lighthouse Festival Parade, including, but not limited to, personal injury, property damage arising from or out of any occurrence, omission, error, or negligence arising from any activity related to said participation. In the event that any litigation is commenced by or against the Applicant, his/her/its heirs or assigns, then the Applicant shall proceed and hold haamless the City of Mukilteo and the Mukilteo Lighthouse Festival Association, its officers, directors, committee members, employees, volunteers, sponsors, contractors and agents, and shall pay all costs, expenses, and reasonable attorney’s fees incurred or paid by the aforementioned entities in connection with such litigation.
